New Delhi says tribunal lacks jurisdiction; treaty remains in abeyance from India’s perspectiveIndia has rejected a ruling by the Hague-based Court of Arbitration concerning the Indus Waters Treaty, maintaining that the tribunal has no jurisdiction over what New Delhi describes as its sovereign decision to keep the 1960 treaty in abeyance. The arbitration panel ruled that the treaty continues to remain in force and also issued interim directions affecting some construction activity at the Ratle hydroelectric project in Jammu and Kashmir. India has never participated in the arbitration proceedings and argues that the parallel process conflicts with the treaty’s Neutral Expert mechanism. The government reiterated that it does not recognise the tribunal or its decisions.
